Divorce by end of the year–Is it possible?

Having a divorce completed by the end of a given year is possible in most situations, but time is of the essence!

People have all sorts of reasons for wanting to finish their divorce by the end of a year…some emotional, some practical, and some financial.  By far, the most common of the reasons is the tax savings that comes from ending your marital status by December 31 of any year and thereby changing your “status” retroactively for the preceding year for tax filing purposes.

California’s statutory 6-month waiting period for completing a divorce has become more complicated due to budgetary issues faced by our courts.  As such, our ability to achieve a year end divorce this year – 2010 – is complicated by:

1.  court closures,

2.  limited court hours for filing documents,

3.  back logs at many courts due to personnel layoffs or furloughs.
